In Wisconsin, qualified patients may possess and use CBD extracts derived from the marijuana plant. CBD extracts can be derived from either marijuana or hemp and each variety is legally defined under different laws in the state. Marijuana CBD oil is only legal for use by patients with intractable epilepsy. The law passed in 2014 limited to CBD use for patients is the only marijuana law currently that allows any type of patient consideration.
Hemp oil can be used by anyone and does not require a physician recommendation. Physicians must have a permit from the FDA to dispense CBD. Currently, the FDA is not issuing permits allowing physicians to dispense CBD. Recently, lawmakers filed a decriminalization bill as many municipalities have followed suit. Voters have approved several questions to be placed on the ballot that would allow actionable legislation in the future.
